1. Acceptance of Terms

By accessing or using WALink.world ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and ABHISHAK MITTAL HUF ("we," "us," or "our"), which operates the WALink platform at walink.world. By using our Service, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.

We reserve the right to refuse service to anyone for any reason at any time, particularly in cases of suspected abuse, fraud, or violation of these Terms.

2. Service Description

ABHISHAK MITTAL HUF provides the following cloud-based software subscription services through WALink:

• WhatsApp Link Generation: Create custom WhatsApp click-to-chat links with pre-filled messages
• QR Code Generation: Generate scannable QR codes that link to WhatsApp conversations
• Photo-Enhanced QR Codes: Create artistic QR codes with embedded photos (Premium feature)
• Custom Domain Links: Branded links using your own domain or subdomain (Premium feature)
• Analytics Dashboard: Track link clicks, QR scans, and engagement statistics
• Batch QR Generation: Generate multiple QR codes for events, products, or inventory

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

3. User Accounts & Responsibilities

3.1 Account Creation

To access certain features, you may need to create an account. You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We use magic link authentication for enhanced security.

3.3 User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not impersonate any person or entity
• Not interfere with or disrupt the Service or servers
• Not attempt to gain unauthorized access to any part of the Service
• Not use the Service to send spam, unsolicited messages, or harass others
• Ensure all phone numbers and content you submit are accurate and lawful

4. Prohibited Uses

You may not use the Service for any of the following purposes:

• Spam or Bulk Unsolicited Messages: Sending unsolicited commercial messages, spam, or bulk messages to recipients who have not consented
• Illegal Activities: Promoting or facilitating illegal activities, including fraud, scams, phishing, or identity theft
• Harmful Content: Distributing malware, viruses, or any malicious code
• Abusive Behavior: Harassment, stalking, threats, or intimidation of any person
• Misrepresentation: Impersonating others or falsely representing your affiliation with any person or entity
• Protected Content: Infringing on intellectual property rights of others
• Adult Content: Promoting pornography, adult services, or sexually explicit material
• Gambling: Promoting illegal gambling or betting schemes
• Weapons/Drugs: Promoting illegal weapons, drugs, or controlled substances
• Data Scraping: Automated collection of data from our Service without authorization

Violation of these prohibitions may result in immediate termination of your account, deletion of your links, and may be reported to appropriate law enforcement authorities.

5. Payment Terms

5.1 Pricing

Our pricing is displayed on the Service and is subject to change. Current pricing includes:

• Free Plan: Basic WhatsApp links with random codes at no cost
• Premium Links: Custom branded links (₹499 one-time payment)
• Custom Domains: Subdomain or custom domain hosting (₹999/year)
• Batch QR Codes: Starting at ₹999 for up to 1,000 QR codes

5.2 Payment Methods

Payments for subscriptions and software licenses are processed through Razorpay, our authorized payment partner. Razorpay may offer UPI, credit/debit cards, net banking, and other methods as available. We do not store full card numbers on our servers.

All payments are processed in Indian Rupees (INR) and are subject to applicable taxes including GST.

5.3 Billing

One-time payments grant lifetime access to the specific feature purchased. Subscription services (like custom domains) will be billed annually. You will receive renewal notices before expiration.

5.4 Refunds

Please refer to our Refund Policy for detailed information about eligibility and the refund process.

6. Intellectual Property

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ABHISHAK MITTAL HUF and its licensors. The Service is protected by copyright, trademark, and other laws of India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6.2 Your Content

You retain ownership of any content you submit to the Service, including custom links, QR codes, and branding materials. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of operating and improving the Service.

6.3 WhatsApp Trademark

WhatsApp® is a registered trademark of Meta Platforms, Inc. We are not affiliated with, endorsed by, or sponsored by WhatsApp or Meta. Our Service facilitates connection to WhatsApp but operates independently.

7. Termination

7.1 By You

You may terminate your account at any time by contacting us at hello@propotech.com. Upon termination, your links may remain active but will no longer be manageable through your account.

7.2 By Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Engaging in prohibited uses
• Non-payment for subscription services
• Extended account inactivity (over 12 months)
• At our sole discretion if we believe termination is necessary

7.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WALINK.WORLD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Errors, mistakes, or inaccuracies in the Service
• Personal injury or property damage resulting from your use of the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

9. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Gurgaon, Haryana, India, to the extent permitted by applicable law.

We may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

We will notify users of material changes via email (if provided) and by posting a notice on our website.
